100% Transferable & Interchangeable Destinations

Seller’s acceptance of buyer’s purchase order is expressly made conditional on buyer’s acceptance of the terms and conditions of the sale contained in buyer’s purchase order as well as all resort terms and conditions pertaining to buyer’s order. Buyer understands that all package(s) purchased, as stated in this purchase order, are 100% transferable to a qualified person(s) and non-refundable. Buyer understands this is not a contest, lottery, or drawing. By providing payment information and billing address, you understand that your credit has been charged for the amount specified in this purchase order, and all sales are final. The travel vendor responsible for the sale submits this information to us; we are the fulfillment center only responsible for assisting in completing reservations.

When purchasing this travel package, you acknowledge that you have read, understood and expressly agreed to these Terms and Conditions, without modification, intend to be legally bound by them and acknowledge and agree that they become part of your contract. Any payment made for a travel package offered to you by the promotion vendor constitutes final acceptance of these Terms and Conditions set forth herein. We may, with minimum 72 hours’ notice to our clients, amend or modify these Terms and Conditions at any time by posting the changes to our website.

Liability Statement

As a condition of participation, the customer hereby agrees to now and forever hold harmless and indemnify Luxury Tour Escapes and its representatives from and against all claims, losses, damages, cause of action, suit, and liability of every kind, including all expenses of litigation, court costs, and attorney fees, for any property damage, injury, death or losses associated therewith, arising from participation in the travel package. Luxury Tour Escapes acts as an agent for the independent travel supplier providing your resort package. Customer hereby agrees to now and forever hold harmless and indemnify Luxury Tour Escapes from the actions or omissions of these independent suppliers including, but not limited to delays, overbookings, cancellation of services, cessation of operations, accidents, failures of equipment, or changes in itineraries or schedules.

Terms of Purchase

Purchaser understands and agrees that the full amount paid for this travel package is non-refundable but may be transferred to a qualified person(s). Please note that separate terms and conditions dictated by the applicable supplier will apply to your reservation and purchase of products and services. You agree to abide by such terms and conditions, including payments of all amounts when due and compliance with the applicable suppliers’ policies, rules, and restrictions regarding availability and use of package, products, and services. You understand that any violation of any such supplier’s terms, conditions, policies, rules, or restrictions may result in your forfeiting any monies paid for such reservation or purchase as well as assuming liability for any amount Luxury Tour Escapes incurs as a result of such violation. You acknowledge that you will be responsible for all charges, fees, duties, taxes, and assessments arising out of your purchase of the travel product. Out of term cancellations (Less than a two week notice prior to check-in date, documentation of the emergency must be submitted) and if you fail to show up (NO SHOW) for a scheduled presentation during your vacation you will automatically be charged a penalty of $600.00 USD penalty fee to cover the retail rate of your stay, the preview presentation is a mandatory part of the vacation stay. I understand that any unused processed payments will be applied to future travel.

Terms of Travel

The package provides complete flexibility in terms of destination selection, enabling customers to exchange the trips on their package to any destination offered by our company. However, the duration of stay at the chosen destination must adhere to the pre-specified number of nights. Please note that certain resorts have specific eligibility criteria that must be met, due to marketing aspect these restrictions are subject to the individual resorts and their policies.

 

  1. The maximum stay duration in European and Asian resorts is six or seven nights depending on the promotional offer during the initial sales call. These destinations are non-inclusive, and a Saturday check-in date is mandatory for most resorts in these destinations. In U.S destinations, the maximum stay is three nights unless otherwise stated in the invoice.

  2. Domestic destinations are also non-inclusive, and certain locations allow only a three-day and two-night stay. The following destinations will only allow three days and two nights stay; California, Texas, South Carolina, Clearwater, Miami, New Jersey, Ormond Beach, Daytona, Hawaii, Sedona

  3. All-inclusive destinations in Mexico, Dominican Republic, and Costa Rica cover two adults and two children (twelve and under) for the entire stay. However, some all-inclusive properties are exclusively for married or cohabitating couples.

  4. At least one traveler in the group must be within the age range of 28 to 75 years with a minimum annual income of USD 50,000.

  5. Customers cannot split days or use vacations consecutively. All separate vacation stays on the package are fully exchangeable for any destination available under the Luxury Tour Escapes umbrella, subject to the days and nights offered at that specific destination. Resorts and hotels may change, and inventory is constantly updated.

  6. The cost of airfare, ground transportation, resort fees, taxes, reservation submission fees, and gratuities are the responsibility of the traveler, unless otherwise stated in the package description.

  7. Airport pickup is typically sponsored by most all-inclusive resorts. During the reservation process, we can assist with scheduling your airport pickup, however, it is important to note that any transportation during the vacation is the sole responsibility of the traveler and not the responsibility of our company.

  8. Bookings, upgrades, changes, and cancellations may be made through the reservations department, and applicable fees may apply.

  9. A proper form of identification (driver’s license, passport, credit card, or other official documentation) must be presented upon arrival at the resort.

  10. Some resorts have eligibility criteria such as age, income, single/married/cohabiting status. Customers are advised to seek more information prior to or at the time of booking their reservation(s).

  11. It is hereby acknowledged and agreed that any travel certificates offered as an additional incentive as part of your purchase, are not fulfilled by our company. Our company disclaims all responsibilities and liabilities for any travel certificates offered, as they will be covered by a third-party company.

  12. All customers are required to take a mandatory ninety-minute plus VIP presentation at each destination they are traveling to. Failure to tour in the required locations will result in a no-show penalty.

  13.  All vacation packages require a minimum of forty-five days advance booking prior to travel dates, and ninety days advance booking if traveling during major holidays. Holiday/Peak season fees may apply based on availability and location.

  14. If a customer is unable to use any portion of the travel package due to any reason such as weather strikes, mechanical failure, civil unrest, disease, environment, government restrictions, or acts of God, any monies paid, not including the original package price, will be applied as future credit to be used for future travel.

  15. Customers may change or cancel reservations with a minimum two-week notice prior to the check-in date without penalty. Any upgrades, resort fees, or add-ons purchased will be held as credit towards a future stay.

  16. Changes to reservations, including itinerary, date change, change in the number of travelers, etc., may result in a new contract being issued to accommodate changes or cancellations.

  17. The purchase of a vacation certificate puts all assignees on notice of the consumer's right to cancel under section 559.933 Florida Statutes. All purchases are sold on a non-refundable basis; however, a 30-day warranty period from the day of purchase is provided in accordance with Florida Statute 559.933.

  18. It is imperative that the purchaser does not rely on any representations other than those explicitly stated within this contract.

  19. We would like to bring to your attention that any incorrect or inaccurate information provided by the customer, for the purpose of qualifying for our travel packages, will lead to the forfeiture of the purchased packages. In such a case, the Customer will also be held responsible for paying the full rate of their resort stay if disqualified from the resort tour.

  20. By signing this agreement, the Customer is agreeing to receive electronic, text, and phone communications from Luxury Tour Escapes. The Customer may choose to opt-out of these communications at any time by emailing us at customersupport@luxurytourescapes.com or texting UNSUBSCRIBE to 1-888-257-2311.
